Terms & Conditions

  1. The Owner hereby undertakes that he/she will not make or cause any mould or plug to be made from the licensed Leisure Pools product that is to be installed on his/her site.
  2. Under no circumstances must your Leisure Pool be emptied without the prior authorization from the manufacturer, if done so the Manufacturer's warrantee is invalid.
  3. Filtration systems and other pool implements carry the respective Manufacturer’s guarantee.
  4. Installation and paving workmanship is warranted by the licensed Leisure Pools Contractor himself. Leisure Pools do not provide warranty on installation and paving should installation be carried out by anyone other than a Leisure Pools Contractor.
  5. The owner shall not involve him/herself in the construction of pool unless requested by the Contractor.
  6. The owner shall provide all the water, electricity, toilet and storage required during construction and/or repairs.
  7. The Contractor shall have no liability whatsoever arising from the late commencement or completion of the pool due to circumstances beyond his control.
  8. Removal of any excavated material, trees or plants does not form part of the contract.
  9. The owners shall take responsible steps to ensure that the sitting of the pool will comply with Municipal by-laws and does not interfere with existing servitudes or underground obstacles such as sewers, cables, water pipes and drains. If these are encountered the cost of diverting same shall be borne by the owner. If planning permission is required, it is the responsibility of the owner to obtain such. Any costs incurred by installation delays due to permission issues shall be borne by the owner.
  10. Abnormal conditions such as unstable soil, turf soil, clay soil and morass or underground water may bear extra costs for the owner.
  11. Should payment of any amounts due, not be made on due date, the Contractor shall be entitled to claim payment of the full balance of the contract price and cease any further work until payment has been made in full. The Contractor shall be entitled to retain as a penalty or alternatively as a genuine pre-estimate of damages, all amounts paid to him.
  12. The owner shall provide access to the work site for all the Contractor’s equipment and materials. The Contractor shall not be liable for any loss or damage caused to the gardens or the property. The owner must lock up all their garden tools except the hosepipe during the construction.
  13. The owner shall not be entitled to cancel the Contract once the product is in shipment. Prior to the shipment, the Contract may be cancelled upon the written acceptance of the cancellation by the Contractor and against payment of 25% of the Contract value. Should in the opinion of the Contractor the cancellation of the Contract be justified, the Contractor may waiver payment of the penalty.
  14. Any plans attached to this Contract and initialled by the parties, shall be deemed to form part of this contract.
  15. There is no guarantee on staining and discoloration of the interior finish of the pool, as the Contractor has no control on treatment of pool water.
  16. It is hereby specified that the equipment will remain the property of the Contractor until full payment has been received from the Owner in terms of this contract. Should the Owner neglect to pay the final payment in any way the Contractor has the right to retain the Pump housing and all contents, until such payment has been received. If the unit has already been installed, the Owner gives the Contractor the right and in rem suam for the Contractor to remove the pump and the motor and to retain it until full payment has been received.
  17. With reference to the measurements in this Contract of the swimming Pool e.g. The size, depths and measurements of the paving is by approximation and the Owner shall not be entitled to deduct any money owing to the Contractor as a result of measurements not being the same as described.
  18. The hole for the swimming pool will be dug and the excess ground will be dumped next to the pool. If the ground is too hard for digging extra cost will be charged for blasting or for the use of a pneumatic drill. The removal or damaging of cables, water pipes and waste pipes is not included in the prices if any problem that occurs under the ground. In weak drainage areas, drains and/or walls will be made at extra costs. The Contractor holds the right to decide over drains. If drains are not made in weak drainage ground, the warranty will no longer be valid.
  19. The owner consents to the jurisdiction of the Varna District Court for any legal procedures.
  20. We maintain the right at all times to change or improve products without any notice or approval of the Clients on condition that the effectiveness of the product will increase.
